GENERAL TERMS AND CONDITIONS & HOUSEHOLD REGULATIONS B&B Bergheide in Baexem May 2021 — last revision dated May 1, 2021

We wish you a warm welcome in B&B Bergheide and we request you to take note of our General Terms and Conditions & House Rules

  1. General • These General Terms and Conditions apply to all guests of B&B Bergheide, Vestjenshoek 4, 6095 NT Baexem. • Where you read 'guest(s)' in these terms and conditions, you can also read 'tenant(s)' or 'user(s)'. • Owners / managers of B&B Bergheide are Anny and Will-Jan van Cranenbroek. The owners / managers can be replaced. Where you read “administrator(s)” in these terms and conditions, you can also read owner(s). • After sending the booking confirmation, the General Terms and Conditions come into effect (see point 4). • Guests of B&B Bergheide must adhere to the House Rules that are provided to them when booking and that are also available for inspection in the accommodation. General Terms and Conditions and House Rules can also be viewed on the website www.B-BBergheide.nl • At violation of the General Terms and Conditions and/or the House Rules, or in the event of inappropriate behaviour, the owner(s) / manager(s) can deny and/or refuse access to B&B Bergheide with immediate effect, without further notice and statement of reasons. and without refund of accommodation costs. • A copy of the General Terms and Conditions / House Rules will be provided free of charge on request.

  2. Bed and Breakfast B&B Bergheide • The accommodation is described on the website www.B-BBergheide.nl, Facebook and Instagram. • This website and social media platforms have been compiled with the greatest care, but there may be differences between the text and/or photos presented on the website and social media platforms and the current situation of B&B Bergheide at the time of the guests' visit. No rights can be derived by the guests from such differences. • Pets are not allowed due to possible allergies of guests who use the B&B after you.

  3. Rates • The current room rates are described on www.B-BBergheide.nl • The rates of B&B Bergheide are without obligation and subject to interim price changes and apparent errors. • Room rates include breakfast, gas, water, electricity, heating and VAT. • Tourist tax (€1.30 per person / night) will be charged extra. • A minimum stay of 2 nights applies for public holidays. • The rates do not include the costs of cancellation and/or travel insurance and/or other costs. • All entries on the website of www.B-BBergheide.nl are deemed to have been provided in good faith and are always subject to interim adjustments. B&B Bergheide is not bound by obvious errors on its website. • The confirmation of your reservation will state the corresponding final rate that was valid on the date of confirmation.

  4. At that time, the General Terms and Conditions & House Rules come into effect. • Without your contact details it is impossible to provide a definitive confirmation. • After confirmation of your reservation, it is final for both parties.

  5. Payment • After the reservation has been confirmed by B&B Bergheide via the contact form, you must transfer an advance of 50% of the total accommodation costs to our account. You can also choose to transfer the total accommodation costs to B&B Bergheide in one go. • If you have not transferred the total accommodation costs in one go, or by means of an advance payment, you must pay the outstanding amount upon arrival. This can only be done in cash. The owner can deviate from these conditions in consultation with the tenant. • The costs must be transferred to bank account number NL38KNAB0604325711 in the name of B&B Bergheide in Baexem, stating the invoice / reservation number. • The other costs, such as drinks/candy/snacks, picnic baskets, card orders, must be paid in cash on departure. You will find the costs on a list in the B&B Bergheide. • If you visit us and stay overnight on the day itself, you will receive your bill on site and you can also make your payment in cash. • Business guests always receive an invoice. Private guests can also request this. • B&B Bergheide cannot accept payment by credit card or bank PIN.

  6. Cancellation / No-Show (don't come without cancellation) • In the unlikely event that you are unable to use the reserved room, you must report this to the owner(s) as soon as possible so that we can use the available room as soon as possible. can offer to others. • In the event of cancellation, the guest(s) pay a fee to the manager: • Cancellation up to two weeks before the booked date / commencement date is free of charge. • In case of cancellation between 14 and 8 days before the booked date / commencement date: 50% of the agreed price. • In case of cancellation between 7 and 2 days before the booked date / commencement date: 75% of the agreed price. • In case of cancellation between 2 and 0 days before the booked date / commencement date: 100% of the agreed price. • No-Show: if you are not present on the booked date/dates without cancellation, 100% of the agreed price will be charged. • To be eligible for a refund of the amount already paid (if applicable), the cancellation must be communicated in writing (by email or by post) to B&B Bergheide. • Amounts owed will be transferred within 14 days to the bank account number NL38KNAB0604325711 in the name of B&B Bergheide in Baexem. An invoice will be provided for this upon request.

  7. Arrival and departure • You will be asked to show your passport or identity card for proof of identity, the number will be noted for the purpose of the night register. • The main guest receives a code from the door of B&B Bergheide, which expires at the end of the booking day. • On the day of arrival, rooms are available from 15:00. • On the day of departure, you must vacate your reserved room by 10:00 am at the latest. • It is only possible to deviate from the above times in consultation with the owner / manager. • No refund will be made in the event of early departure.

  8. Breakfast • Breakfast is included in the accommodation costs. If you do not use breakfast, we cannot calculate a discount or deduct costs. • If you have any dietary requirements, please indicate this at least one day before arrival. • Breakfast is served between 7:00 AM and 10:00 AM (during the week) and from 8:00 AM to 10:00 AM on weekends. If you want to have breakfast earlier, this is only possible in consultation with the owner(s). • You can have breakfast in the B&B and on the terrace. Breakfast can be served in bed in consultation.

  9. Your stay • Noise pollution, especially between 22:00 and 07:00, must be prevented. This applies not only to the B&B itself, but also to the terrace. • Radios, televisions, and other sound sources should not cause a nuisance to others. • Possible visitors of guests are not allowed to stay overnight in the accommodation without the permission of the owner(s) / manager and without additional payment. • Guests must adhere to the instructions for use as made available through explanation of the owner(s) / manager(s) and as described in the manuals that can be found in the B&B.

  10. Safety and environment • Guests must follow instructions from the owners / manager. • Vehicles must be parked in the designated parking spaces. • The accommodation must be kept clean and tidy and must be vacated on time. • Where you can find the first aid box and fire extinguishers will be indicated on your arrival. • Immediately report the presence of suspicious persons / activities to the owner(s) / manager. • Smoking, incense and open flames are not allowed for fire safety reasons. • The bedrooms are suitable for an overnight stay of a maximum of two people. • The accommodation is accessible 24 hours a day during a stay • The code is available from the owner(s) / manager(s)

  11. Liability • The owner(s) / manager(s) cannot be held liable for personal injury resulting from the stay in our accommodation and cannot be held liable for damage, loss or theft of property of the guests. In case of disputes, all (legal) costs are for the account of the guests. • All risks related to a stay at B&B Bergheide are for the account of the guests. • Damage and loss of movable and immovable property belonging to the owner must be immediately reported by the users to the owner(s) / manager(s) and reimbursed. • B&B Bergheide is not liable for malfunctions in and around the accommodation, such as malfunctions and failures of electricity and water supplies and technical installations, construction and/or road works not announced or untimely announced in the vicinity of B&B Bergheide.

  12. Complaints, differences of opinion • The guest is always entitled to submit his grievances to the owner(s) / manager(s) by means of a complaint. These will always handle a complaint adequately and expeditiously, in such a way that the complaint is handled according to standards of reasonableness and fairness. • The administration of the administrators is decisive in the event of a mutual difference of opinion, unless the users can prove the contrary. • The owner decides on any deviation that is not included in the General Terms and Conditions. • Mutually insoluble differences/insights will in the first instance be settled through mediation.

  13. Force majeure • In case of force majeure, both permanent and temporary, the owner(s) / manager(s) are entitled to dissolve or temporarily suspend the agreement in whole or in part, without the guest(s) being entitled to fulfillment and/or or claim compensation. • Force majeure includes, but is not limited to: danger of war, war, insurrection, war, strikes, boycott, disruptions in the energy circuit, traffic or transport, government measures, scarcity of raw materials, natural disasters and furthermore, all circumstances, extraordinary weather conditions, death of one of the owners or close relatives, etc., under which full or partial fulfillment of the agreement cannot be expected from the owner(s) / manager(s) in reasonableness and fairness.

  14. Privacy • The personal data provided or made known will be treated confidentially by the owner(s) / manager(s) and will not be made available to third parties, with the exception of legal obligations.

  15. Final provision • Insofar as not provided otherwise in rules of private international law, the present terms and conditions are exclusively governed by Dutch law. Non-Dutch speaking guests are deemed to agree with the general terms and conditions. • All disputes arising from the user agreement or these terms and conditions will be settled in the first instance by a mediator. If no agreement is reached here by the competent court in the Netherlands, insofar as the rules of private international law do not provide otherwise. • None of the parties can transfer its rights and obligations to third parties unless otherwise provided in these terms and conditions.
